Parental Responsibility in the State of Florida is the decision making authority of the parents over the issues that involve their child(ren}.
In most circumstances, Florida Courts award shared parental responsibility which means that parents must make joint decisions regarding their child(ren}'s education, health care, and religious preferences. Under certain circumstances, sole parental responsibility or ultimate decision making authority may be awarded to one parent.
One circumstance that may allow a Court to award one parent sole parental responsibility would be when domestic violence has occurred against a spouse or the child(ren). Your attorney can address the facts of your case and advise was to what type of parental responsibility will probably be awarded if the matter must go to trial. In summary, Florida Law presumes that both parents should share the parental responsibility for the minor children, unless it is detrimental to the children.
